Terms of Service

By creating a FortyBooks account, accessing the service or using the FortyBooks website or mobile applications, you agree to these Terms of Service and the Privacy Policy. If you use FortyBooks on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the service.

You must be legally capable of entering into a binding agreement in the jurisdiction where you use FortyBooks. You are responsible for providing accurate registration information, protecting your credentials and all activity performed through your account. Notify us promptly if you believe your account has been compromised.

FortyBooks provides software tools for bookkeeping, invoicing, estimates, billing, customer and product records, expenses, payments, transactions, reporting and related business administration. Features may differ by platform, subscription, country or release and may be updated over time.

FortyBooks is a record-management tool. It is not an accounting firm, tax adviser, law firm, bank or regulated financial adviser, and information produced by the service is not a substitute for professional advice.

Where offered, a free trial allows you to evaluate FortyBooks for the stated trial period. Paid plans, prices, billing periods, included features and applicable taxes are shown before purchase. By purchasing a subscription, you authorize the applicable payment method or payment provider to charge the disclosed amount.

Unless a plan states otherwise, subscription access continues for the purchased billing period. Renewal and cancellation rules shown at purchase or in your account form part of these Terms. Refunds are governed by our Refund Policy and mandatory consumer law.

If a subscription or other purchase is made through Apple App Store, Google Play or another third-party marketplace, additional marketplace terms may apply. Billing, cancellation and refund processing for those purchases may be controlled by the marketplace rather than FortyBooks.

You retain ownership of content and business records you submit to FortyBooks. You grant us the limited rights necessary to host, copy, transmit, process and display that content solely to operate, secure and improve the service and to comply with law.

You are responsible for the accuracy, legality and suitability of information entered into your account, including personal information belonging to customers, employees, suppliers or other contacts.

You must not use FortyBooks for unlawful, fraudulent, abusive or deceptive activity; attempt to gain unauthorized access to systems or data; interfere with the operation or security of the service; upload malware; scrape or reverse engineer the service except where applicable law expressly permits it; impersonate another person; infringe intellectual-property or privacy rights; or use the service to send unlawful or unsolicited communications.

FortyBooks, its software, branding, user interface, documentation and related materials are owned by or licensed to FortyHives Innovations and are protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during an active trial or subscription. No ownership rights are transferred to you.

FortyBooks may depend on or integrate with third-party services including payment providers, hosting providers, identity providers, communications services and app stores. We are not responsible for the independent acts, outages, terms or privacy practices of third parties, though we take reasonable care when selecting providers used to operate FortyBooks.

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free or permanent availability. Maintenance, updates, internet failures, third-party outages, security events or events beyond our reasonable control may affect access. We may modify, add or remove features where reasonably necessary to improve, secure or operate FortyBooks.

We may suspend or restrict access where reasonably necessary because of non-payment, security risk, suspected fraud, unlawful use, material breach of these Terms or a legal requirement. Where practical, we will provide notice and an opportunity to resolve the issue.

You may stop using FortyBooks at any time. Account deletion may be requested through the available in-app flow or https://fortybooks.co.ke/delete-account.html. Termination does not eliminate payment obligations already incurred or legal retention obligations.

To the maximum extent permitted by law, FortyBooks is provided on an “as is” and “as available” basis. We disclaim implied warranties that may lawfully be excluded, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that calculations, reports or records will satisfy every accounting, tax or regulatory requirement applicable to your business.

To the maximum extent permitted by law, FortyHives Innovations will not be liable for indirect, incidental, special, punitive or consequential loss, or for loss of profits, revenue, goodwill, business opportunity or data arising from use of FortyBooks. Where liability cannot be excluded, our aggregate liability arising from the service will not exceed the amounts you paid for FortyBooks during the 12 months immediately preceding the event giving rise to the claim, unless applicable law requires a greater amount.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct or any mandatory consumer rights.

To the extent permitted by law, you agree to defend and indemnify FortyHives Innovations against third-party claims, losses and reasonable costs resulting from your unlawful use of FortyBooks, your violation of these Terms, or content you submit that infringes another person’s rights.

These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules, unless mandatory law in your place of residence requires otherwise. We encourage you to contact us first so we can try to resolve any dispute informally. Where a dispute cannot be resolved and applicable law permits, the courts of Kenya will have jurisdiction.

If you are entitled to mandatory consumer protections in another jurisdiction, nothing in this section removes those protections or any right to bring a claim in a forum that applicable law requires.

We may update these Terms when FortyBooks, applicable law or our business practices change. The revised version will be posted with a new “Last updated” date. Where required, we will provide reasonable notice of material changes. Continued use after an update takes effect constitutes acceptance where permitted by law.

If any provision of these Terms is held unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent, except where applicable law permits otherwise. We may assign these Terms as part of a corporate reorganization, merger, acquisition or transfer of the FortyBooks business.
